Italy and the Unitary Patent: what figures reveal 8 months after UP’s inauguration

One in three Italian applicants for a European Patent have opted for the Unitary Patent since it became available eight months ago: Italy is the fourth country for number of Unitary patents requested, but is second only to France for uptake rate of the new single patent right covering 17 European Union states.

Italy and the Unitary Patent

The Unitary Patent (UP), the new single patent right covering 17 states of the European Union, opened for business on 1 June 2023.

Just over eight months later, filing figures show that Italian companies have taken to the new patent right: according to the statistics of the European Patent Office, Italian applicants have so far requested the “unitary effect” (thus taking the step that makes a European patent become a UP) in 1,048 cases: this means that one in three Italian applicants for a European patent have opted for the UP since the new right was launched.

Italy ranks fourth for number of UP requests after Germany, the USA and France, but if you look at the UP uptake rates, meaning each single state’s percentage of European patents for which unitary effect has been requested, Italy, with a 33% rate, is second only to France, that comes first with a rate of 39%.

The table below shows the top 5 countries for number of UP requests (up to 6 February 2024). A higher UP uptake rate does not necessarily relate to a higher number of Unitary patent requests: France, followed closely by Italy, would lead a ranking based on the UP uptake rate, with Germany in third place and the United States coming last.
