According to the ministry\u2019s <a href=\"https:\/\/www.esteri.it\/it\/sala_stampa\/archivionotizie\/comunicati\/2023\/05\/tribunale-unico-dei-brevetti-italia-otterra-sezione-distaccata-per-milano\/\" target=\"_blank\" rel=\"noopener\">press release (in Italian)<\/a> the agreement reached in negotiations with France and Germany will be submitted to other UPC participating states to be formalised during the next meeting of the Administrative committee.<img class=\"size-full wp-image-23111 alignright\" src=\"https:\/\/www.sib.it\/wp-content\/uploads\/2022\/08\/Milano-grattacieli450.png\" alt=\"TUB Milano sede centrale\" width=\"450\" height=\"299\" srcset=\"https:\/\/www.sib.it\/wp-content\/uploads\/2022\/08\/Milano-grattacieli450.png 450w, https:\/\/www.sib.it\/wp-content\/uploads\/2022\/08\/Milano-grattacieli450-300x199.png 300w, https:\/\/www.sib.it\/wp-content\/uploads\/2022\/08\/Milano-grattacieli450-150x100.png 150w\" sizes=\"(max-width: 450px) 100vw, 450px\" \/><\/p>\n<p>The document points out that other UPC states have accepted Italy\u2019s arguments in support of Milan\u2019s candidacy and confirms that the third central division will become operative in about a year, as was already expected (more <a href=\"https:\/\/www.sib.it\/en\/flash-news\/upc-cases-concerning-human-necessities-chemistry-and-metallurgy-temporarily-allocated-to-paris-and-munich\/\" target=\"_blank\" rel=\"noopener\">here<\/a>).<\/p>\n<p>No reference is made to the issue of the competencies of Milan\u2019s central division; one may assume that discussions with France and Germany on this point, obviously the most controversial, are not over.<\/p>\n<p>The communique does specify however that the decision to assign the third central division to Milan will, as requested by the Italian government, \u201cbe subject to early revision in 2026, much earlier than stipulated by the Agreement (2030), which will allow the assessment of the division\u2019s proper functioning, and the correction of any imbalances, to be carried out sooner.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p><em>Related content<\/em><\/p>\n<p><a href=\"https:\/\/www.sib.it\/en\/enforcement\/upc-unified-patent-court-hub\/what-is-the-unified-patent-court\/\" target=\"_blank\" rel=\"noopener\">Visit our UPC hub<\/a><\/p>\n<p><a href=\"https:\/\/www.sib.it\/en\/enforcement\/upc-unified-patent-court-hub\/upc-team\/\" target=\"_blank\" rel=\"noopener\">Our UPC team<\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>Milan will be the seat of the third central division of the Unified Patent Court: Italy\u2019s Foreign ministry has confirmed that an agreement has been reached with France and Germany, and that Milan\u2019s central division will begin operations in about a year.
