{"id":4413,"date":"2017-03-29T16:32:32","date_gmt":"2017-03-29T16:32:32","guid":{"rendered":"http:\/\/www.sib.it\/?p=4413"},"modified":"2017-03-29T16:32:32","modified_gmt":"2017-03-29T16:32:32","slug":"la-spagna-rimane-fuori-dal-brevetto-unitario-conferma-del-governo-spagnolo","status":"publish","type":"post","link":"https:\/\/www.sib.it\/en\/flash-news\/spain-not-joining-unitary-patent-says-government-representative\/","title":{"rendered":"Spain not joining unitary patent, says government representative"},"content":{"rendered":"<p><em>Minister de Guindos answers the parliament\u2019s motion by explaining that there are no plans to join the unitary patent and confirms the government\u2019s opposition to the language regime.<\/em><\/p>\n<p>A minister of the Spanish government has said that <strong>Spain is not likely to join the unitary patent<\/strong> in the foreseeable future.<a href=\"https:\/\/www.sib.it\/wp-content\/uploads\/2017\/03\/Toro.jpg\"><img class=\" size-full wp-image-4416 alignright\" src=\"https:\/\/www.sib.it\/wp-content\/uploads\/2017\/03\/Toro.jpg\" alt=\"Toro\" width=\"395\" height=\"304\" srcset=\"https:\/\/www.sib.it\/wp-content\/uploads\/2017\/03\/Toro.jpg 395w, https:\/\/www.sib.it\/wp-content\/uploads\/2017\/03\/Toro-300x231.jpg 300w\" sizes=\"(max-width: 395px) 100vw, 395px\" \/><\/a><\/p>\n<p>Earlier this month the Spanish parliament\u2019s committee for the economy, industry and competitiveness <a href=\"https:\/\/www.sib.it\/en\/flash-news\/spanish-parliament-wants-to-reconsider-joining-unitary-patent\/\" target=\"_blank\">approved a motion<\/a> requesting the government to re-examine the possibility of joining the unitary patent system.<\/p>\n<p>Last week Luis de Guindos, Spain\u2019s Minister of the Economy and Competitiveness, said during a session of the Spanish parliament that it is impossible for Spain to join the unitary patent system because of the <strong>language regime<\/strong> and because the government has doubts as to the legal protection it offers.<\/p>\n<p>Mr de Guindos said that Spain was originally in favour of the creation of an EU-wide patent system, but that the language regime adopted for the unitary patent does not allow the use of Spanish, making the system <strong>discriminatory against Spanish-speaking companies<\/strong>.<\/p>\n<p>A Spanish enterprise would be forced to translate its unitary patent applications into English, French or German. There would be a further disadvantage in having to avoid the infringement of unitary patents valid in Spain without a Spanish translation being available.
