New EUIPO guidelines on the registration of European Union designs
The new EUIPO Guidelines on the registration of European Union designs, in force from 1 June 2026, do not introduce further substantive elements; rather, they represent an adaptation of formalities and examination practice to certain aspects already covered by the Design Package introduced in May 2025 (see our news item).
Particular attention is dedicated to new forms of digital design representation (dynamic representations, animations), and to the technical requirements (format, size) of such representations.
The new Guidelines formally establish that the clarity of representations is a requirement upon which the assignment of the filing date depends, and they introduce specifications on the use of disclaimers and the admissibility of non-substantive design modifications after filing.
Regarding invalidity proceedings, the directives have been reorganized with more precise indications on the evidence of prior rights, the use of material found online, and the incorporation of the most recent case law trends.
We note that at least some of the changes will need to be tested in practice, which will further clarify their scope and impact.
