Italian patent box confirmed

ITALIAN PATENT BOX

The bill that introduces a tax break on profits made from intellectual property rights arising from R&D activities was passed into law on Monday.

On 22 December 2014 the Italian Parliament gave its final approval to the bill that introduces a tax break, applicable also to foreign companies, on profits from intellectual property rights.

The so-called “patent box” measures will apply to profits made from patents, trademarks and know-how that are the result of R&D activities. Exactly which categories of trademarks will be eligible is to be specified by implementing rules that will issued after publication of the law. Efforts to make the Italian patent box applicable to all trademarks made earlier this month (see news item) have proved unsuccessful.
