SIBprima April 2025 NGT plants in the EU – Cross-border patent litigation – EU designs reform – Italy Trademark Firm of the Year

An agreement has been reached at long last on a regulation allowing certain NGT plants, whether or not they are covered by a patent, to be grown in the European Union; expected to be approved by end 2025, the new rules will open previously barred markets to innovative players in the biotech and agritech sector. CJEU issues game-changing ruling for cross-border European patent litigation

According to a recent ruling of the Court of Justice of the European Union, if an action for infringement of a European patent valid in several states is filed in the EU state of residence of the defendant, the court has cross-border jurisdiction on the infringement in spite of defensive invalidity actions brought by the defendant in a different state of validity of the patent.
