Italy’s new administrative procedure for trademark revocation and invalidity

A new administrative procedure is available in Italy to obtain the revocation or invalidity of a trademark registration by applying directly to the Italian Patent and Trademark Office. (more)

ITALY – TRADEMARK CASE LAW   

Slogans are registrable as trademarks in Italy, provided they possess distinctive character

The Italian Supreme Court has ruled that national law allows the registration of slogans as trademarks, but all registrability requirements, including distinctive character, must be satisfied as for any other kind of trademark. (more)

EUROPEAN UNION – TRADEMARK CASE LAW  

The Louboutin-Amazon judgement: change of course on liability of e-commerce platforms for trademark infringement?

In The Court of Justice of the EU has held, in its decision on the Louboutin-Amazon case, that the operator of an online e-commerce platform may be held liable for trademark infringement in certain circumstances; is this a change of course for the CJEU regarding liability of e-commerce platforms for trademark infringement? EUROPEAN PATENTS – UPC UPDATE

UPC kick-off postponed, Sunrise period to begin 1 March 2023

The Unified Patent Court’s inauguration has been postponed until 1 June 2023, and the Sunrise period will begin on 1 March 2023; the postponement has not affected the decision of the European Patent Office (EPO) to start applying on 1 January 2023 the transitional measures encouraging an early uptake of the Unitary Patent. Women and patents in Europe: new EPO study provides data, evidence and insights on gender gap

How inclusive is inventive activity in Europe? Are women scientists being denied equal opportunities?
A study by the European Patent Office confirms that there is still a disproportionately low number of women from European patent member states applying for European patents; the gender gap is out of scale with the number of women who are active in business and science. (more)
